The concerned professional shall report to the Authority about the violation of the building permit by the owner without the revised permit failing which the Authority shall make such recommendation to the statutory / Chartered body governing such profession.



9.1. 3a

The Professional shall also intimate & record with the Authority either by posting a registered letter or by courier or by submission at the Authority�s appointed desk a letter in this regard that the owner has not been utilising the professional service pertaining supervision by the incumbent professional & that no responsibility shall be shared by the professional regarding the undertaking submitted supporting the building permit application which from now onwards be treated null & void.

With immediate effect of such submission by the professional, the building permit shall be suspended by the Authority until the owner appoints & notifies another professional to supervise and clearance from the complaining professional certified regarding the professional fee dues & no extension in respect of the building permit validity shall be allowed.

Also the completion for the residential buildings of plot size 500 sqm in addition to plans approval shall be permitted to be issued by the Architect / Engineer & recorded with the Authority.

12.5 Fees The Authority may charge a process fee at the rate 3 to 5 rupees per sqm of covered area for the area submitted for approval which shall be the total fee payable by the owner until the occupation certificate is issued by the Authority.

In case of the rejection of the plans, the fee shall be recharged.



There shall be no fee chargeable from the owner for the correction resubmission of the observations any number of times.

After the expiry of one and a half year of the validity of the building permit remaining in force, the work has not been commenced by the owner & the revision is applied to the previous approved plans, 50 % of the amount for the fresh submission shall be charged as revision fee.



No refund shall be made to the owner in case the building is not at all constructed & the permit time lapses.



12.8.1

In case the professional records with the Authority regarding the non-compliance by the owner overruling professionals instructions, the revocation shall be affected if compounding is not acceptable.

Engineer

Since engineer has to take instant decisions in the project designs & during the construction of buildings factually involving complex process of engineering operations in theory, designs & practice, which it is not expected of a fresh graduate or a post graduate be in a position to handle independently without undergoing/possessing tutorial experience under the control of a qualified & experienced engineer in the field of design or execution.



An Engineer shall have a minimum accredited Indian or foreign engineering degree BE/B Tech/Section A & B of The Institution of Engineers [ India ] in Civil Engineering branch.

In addition to above, the engineer shall be a Corporate Member of The Institution of Engineers [India] attached to the Civil engineering division and authorised to use the style & title Chartered Engineer [India] minimum AMIE

[BE+(5-10 years)/ ME+(3-8years)/ Phd+(2-7) years].



Competence

By virtues of the IEI royal charter of incorporation 1935 the Corporate Members Chartered Engineers [India] draw the following powers to be utilised in the professional pursuit.

Engineer shall maintain soft copy records for all designs & produce for presentation if so required by the owner or the Authority

A Structural Engineer shall be having a minimum accredited Indian or foreign engineering degree BE/B Tech/Sec A & B of The Institution of Engineers[ India ] in civil engineering branch.

The minimum qualification of a supervisor shall be as follows



An accredited engineering degree in civil engineering & registered as AIE with IEI



Three years accredited civil or architecture diploma with 5 years experience in the building engineering field under the supervision of an Engineer or Architect or structural Engineer & registered as senior technician with IEI or licensed by the Authority

A-2.6 Project Management Engineer



To improve the buildings design & constructions execution controls which have been adversely effected in India due to bad workmanship & designs in the past many years & due to engineering development in the building engineering disciplines, many advanced technologies have come up to replace the obsolete know how, engineers of generally all disciplines shall be contributing in the design as well as in the field offices to the achievement of quality buildings production objective. There has arisen needs nationally as well internationally that these members of the team have to be controlled by a general command so that proper coordination is maintained all times to run smoothly process of designs & construction.



To meet such a demand some very senior engineering personnel experienced in the buildings field is a necessity & hence Management Engineer to share the responsibility of an overall Project Engineer is entitled.



Also the WTO regime requires international mobility effective 2004/2005 & the standards have to be met globally.



In the year 2003, Engineers Mobility Forum an international body to regulate the Professional Engineers according to the provisions under WTO regime has granted provisional membership # 13 to the Institution of Engineers [India] to represent India on its forum. The engineers so registered shall be free to practise anywhere on the globe without any further verification of individual engineering credentials.



Qualifications

A Management Engineer shall be qualified as one of the followings



A A very senior professional expert registered with the IEI as Professional Engineer [India] attached with Civil or Architectural engineering division or



B An architect with an experience not less than 15 years in the buildings & senior member of the Institution of Architects India since there is no provision in the Architects Act 1972 for Senior Architect registration & shall be supported by an Engineer for the structural matters Or



C A Professional Engineer experience in the buildings engineering discipline registered with Engineers Mobility Forum effective 2004/2005



Competencies



To enter into a management contract with the building owner under agreed contract terms & conditions of engineering fee structure, all according to the Indian Contracts Act provisions guidance so that the equity based contract is established.



Management Engineer shall be an overall in charge of all the operations of a major project including all the competencies of an Architect & an Engineer / Structural Engineer where one Architect or Engineer /Professional is inadequate & shall be directly accountable to the promoter or the owner & the Authority.



Overall responsibility of works adequacy & correctness, budget control & cost planning, quality assurance, time management & control, health & safety, environment control, coordination, site management control, contractor�s performance controls & all possible unlimited responsibilities with full professional obligations to bring the project to a successful completion.

Construction Project Site Agent/ Construction manager

Qualification
