Dear sefiens and respected seniors. I request for your opinion in the following matter. I have provided structural design and supervision to a site of an educational trust. The contractor being a partner of one of the directors neglected my instructions and made following deviations and mistakes during the work. A. Members of trusses are joined such that their axes do not meet at a point. B. Six trusses are out of plumb up to 5 c.m. in 1.2 m height. C. Ends of the square pipes used are not sealed. These are the visible defects. Now the chairman is pressurising me to issue certificate and have held back my payment also. Expecting your opinion and advice. Thanks. Patwe prashant |

Dear Mr. Prashant, Pressurizing and holding back payments are normal tactics followed by some and is not unusual. However you may right official letter that the rectification to be done to set things in order and if done and approved by you you are willing to issue certificate of compliance of work. In case you still find no measures are taken to comply with your views then you may forward the same letter to statutory authorities such as municipal corporation, factory inspector etc as safety issue. However at any given time your fees are at stake and may not receive the same, these are civil matters and going to the court is only way for settlement. Regards Umesh Rao |
